Convict to be executed for girls' murders

An Arizona convict is just days from execution for raping and killing two teenage girls while his co-defendant is now a free man.

Richard Stokley, 60, will, barring an unlikely stay of execution from the U.S. Supreme Court, be executed Wednesday in Florence, while Randy Brazeal, 41, was released from prison last year and has married, The Phoenix Arizona Republic reported Saturday.

Evidence ultimately showed the two raped, strangled, stabbed and stomped on their victims, Mandy Meyers and Mary Snyder, both 13, in July 1991 before tossing their bodies into a flooded mine shaft.

Brazeal got a plea deal, ostensibly because the Cochise County attorney said the constitutional time limit for a speedy trial would run out before DNA results could be finalized.

Matthew Borowiec, the judge in both defendants' cases, said, "They presented [the plea deal] as if there weren't much alternative. I didn't have a feeling that one was less culpable than the other."

The DNA evidence of Brazeal's guilt was not available in time for his Oct. 22, 1991, trial, the newspaper reported.

Stokley, however, had waived his right to a speedy trial and the DNA evidence was ready by the time he stood trial.

Brazeal entered into a plea bargain on two counts of second-degree murder, for which he received two concurrent, 20-year sentences. (UPI)

하지만 브라즐의 형은 DNA 테스트 결과가 나오기 전 신속재판을 진행할 수 있는 법적 유효기간이 끝나기 때문에 표면적으로 당국과 사법 거래를 보았다.

양 재판을 담당하는 재판부는 “사법 거래는 마지못해 꺼낸 대안일 뿐 한 명이 다른 한 명 보다 더 죄가 가볍다고 생각하지 않는다” 라고 말했다.

현지 언론에 따르면 브라즐의 형을 증명하는 DNA테스트는 브라즐의 재판이 시작되는 1991년 10월 22일까지 완료되지 않는다고 한다.

스톡리는 신속재판을 요구하지 않았고 DNA테스트 결과는 재판이 시작되기 전 나왔다. 하지만 브라즐은 신속재판을 진행하였고 두 사건에 대한 20년 형을 선고 받은 바 있다. (코리아헤럴드)
