아마존, 화장품 브랜드 '러쉬' 상표권 침해 소송 휘말려
러쉬, 상표권 침해 소 제기…"다윗과 골리앗의 싸움"

영국에서 법인세 납부 회피 의혹을 받아온 세계 최대 온라인 소매업체 아마존이 이번에는 영국의 화장품 브랜드와 상표권 침해 소송에 휘말렸다.
30일(현지시간) 영국 일간지 가디언에 따르면 영국 핸드메이드 화장품 브랜드 러쉬(Lush)가 자사의 상표권을 침해했다며 아마존을 상대로 소송에 나섰다.
러쉬는 아마존에서 자사 제품을 판매하고 있지 않은데 이 사이트에서 '러쉬'를 검색하면 다른 회사 상품이 함께 제시돼 상표권을 침해당했다고 주장했다.
이 회사는 소장에서 "아마존 웹사이트에서 '러쉬'를 검색하면 해당 단어가 포함돼 있지만 실은 러쉬에서 생산하지 않은 제품이 포함된 결과가 나온다"며 "이에 러쉬의 상표권이 침해됐다고 판단해 소송을 진행한다"고 밝혔다.
러쉬는 또한 아마존이 구글의 검색 연동 추천광고인 '애드워드'(AdWord)에 '러쉬 목욕용품'으로 뜨도록 했지만 사실은 자사 제품을 판매하고 있지 않다고 덧붙였다.
가디언은 러쉬가 비교적 소규모 회사지만 동물실험에 반대하고 수익의 2%를 환경단체에 기부하는 등 엄격한 윤리기준을 적용하고 있다고 소개하면서 이번 소송을 '다윗과 골리앗의 싸움'이라고 표현했다.
러시의 공동 창업자인 마크 콘스탄틴은 "아마존이 자사의 서비스 제안을 거절한 우리 회사를 괴롭히고 있다"고 성토했다.
그는 "아마존이 자립 가능한 사업 없이 버틸 수 있는 것은 납세 의무를 회피하기 때문"이라면서 "(아마존의 행태는) 전통적인 자본주의가 아니라 해적 자본주의"라고 비난했다. (연합뉴스)

Lush accuses Amazon of infringing its trademark
A cosmetic brand Lush has filed complaints against online retail giant Amazon for alleged infringement of its trademark.
Lush, famous for its handmade bath products, accused the online retail giant Saturday of “bullying businesses to use its services” when Lush refused Amazon to sell its products.
According to documents filed in court, the search field on the Amazon website showed alternative products that were not made by Lush upon the search term of their brand name. Amazon reportedly has also bid on Google Adword “Lush Bath Products” not to show any Lush products.
Mark Constantine, the cofounder of the cosmetics company, criticized Amazon of “piracy capitalism.” “It doesn’t have a viable business model. The only way it can afford to run it is by not paying tax,” he said.
Depending on the court rulings expected early next year, Lush may be able to prevent other online retailers including Amazon from making alternative products appear on both search fields within their individual sites.
